I only was downloading DS Games so far. It was doing it randomly, not on a specific game it seems since I tested attempting to download the same game twice, first time it downloaded, second time it gave me the error, third time it downloaded. I can try downloading some of the other handheld system games though if you need the info about if it does it on other games too.
Is it only DS games? Either way, what games are you downloading?
