Legal, no, in a moral sense yes. But don't worry about being guilty of downloading older ROMS that you can't purchase any more, your ISP won't give a damn for doing so.

It's legal to download a ROM of a game that you own and hasn't been distributed, sold, and commercial for a long time. For example, I downloaded super smash bros brawl from here. I already own the game, and its over 10 years old now, it hasn't been sold for a long long time.
