Downloading copyrighted games from any website is illegal. (Almost every video game in existence is copyrighted. Gaming is too new of a concept for anything to age into public domain yet.) The only legal way to emulate video games with an unofficial emulator is to already own a physical copy of the game and dump the ROM onto your PC.
However, the laws aren't that enforced, so it's not like you're going to go to jail if you download it.

is it legal to download games from this website? i've been looking at rom legality and so far if its copyrighted its no. is that the same thing for this website?
