It seems likely. The notices are coming from mm-nintendo.com, which isn't owned by Nintendo themselves, but a brand protection company called MarkMonitor. MarkMonitor are payed by big companies to do work like this, and it seems legit that they are indeed hired by Nintendo to do this.
Not sure if we can be absolutely 100% certain, but from what I understand it seems very likely.
And it's hard for Vimm to just ignore it all and pray there won't be a lawsuit.
