That provision only applies to the second portion of Title I of the DMCA, regarding the circumvention of DRM protections. Specifically, while it is normally illegal for a person to circumvent DRM protections, one of the multiple exceptions to this rule is for allowing archival operations to circumvent DRM for the purposes of preservation of digital works. DMCA takedown notices are filed under Title II, which protects online service providers from being held criminally liable for distribution of copyrighted content so long as they take down any infringing content once they are made aware of it by the rights holder or an agent acting on behalf of the rights holder.
