Those are the reasons why Vimm doesn't use current systems. Long ago Nintendo did take down all the NES roms that were here. Putting up a 3DS vault would bring the site to their attentions near immediately.
While I would love to play certain gems on the 3DS, I feel that Nintendo is most protective of the Wii u and 3DS generation of consoles, taking down YouTube videos of CEMU emulator tutorials. Maybe in a few years after the switch becomes the primarily protected console.
