Why would Markmonitor pretend to be acting on behalf of Nintendo? Why isn't this the far more likely case that Nintendo hired Markmonitor to outsource DMCA takedown requests, and Markmonitor in turn used an automated script to send the takedowns, and the script wasn't perfect and didn't catch everything?
The real Nintendo would have removed every trace of their game and systems off the site, not just delete all the Mario, Zelda, and Kirby titles.
