Legally, a publisher can easily delegate these tasks to a trusted third party, such as Markmonitor or the ESA.
Legally, the ESA cannot do anything since they do not own anything of the companies mentioned. Their C&Ds just amounts to "stop, or we'll snitch." It is up to publishers to decide if they want to take legal action.
