Preservation and distribution are not the same thing. Redump and No-Intro are extremely well-run preservation projects, but they make a point of not providing downloads for any reason.
Vimm doesn't have to make a download link available to preserve a game. As long as the game is in the database, it is preserved.

I believe this site was run by only 1 person and the owner might have panic without thinking better. He only took down what he believes might have caused the warning unless the warning he got says a list of certain games the ESA didn't want him to include here for download. Small preservation groups usually don't last long on their own unless they are a larger group with a much bigger library but taking down just some of the games without shutting the whole thing down is NOT preservation!
