It's not outside their jurisdiction; as long as the company owns the copyright they can make a DMCA takedown request.
Just found a European game that's down due to the ESA. That's outside their jurisdiction is it not? Vimm, check what got taken down, you can safely put back any non-American roms supposedly claimed by the ESA.
