If Nintendo were to seem tolerant of copyright infringement for a long enough period of time, it could be taken as precedent that certain acts such as third party archival and preservation are generally accepted as non-infringing, which would be damaging to Nintendo's exclusive ownership of their intellectual property in the long term. The occasional crackdown on unauthorized copying protects the institution of copyright more than it does the profitability of any individual work.
what's the point of taking them down? it's not like these old unsold games being on here is gonna hurt nintendo.
