It's not that they'd lose their copyright, it's that if certain acts are not consistently treated as copyright infringement, then that opens up room for a legal defense of those acts as non-infringing. The world of fair use is in many places a legal gray area dominated by precedent, and if rights holders want to maintain the precedent that archival plus distribution is piracy, then they need to consistently act under that interpretation and issue takedowns whenever they are made aware of unauthorized distribution of their IP.
