I've always been under the impression this website was hosted in France, where the laws are a bit more flexible when it comes to roms. But from what his post said, it's probably simply just about hosting only "abandonware", games that have been abandoned by their original publisher and that are therefore generally accepted as ok by the Internet community. Less likely to have white knights complain to the authorities about this website.
However, that does not change the law. I'm glad this place has been running for so long. I do not need it anymore for the most part but this always has been my go-to place for roms. From back when it took an hour per MB to download a game up to now.
