A problem group the long and short of it. To give a very quick and short summary.
One of the source and supporters of AI for use in copyright claims and antiarchive and fully against data preservation and private rights and consumer software ownership rights.

The previous president Mike Gallagher, also was openly in support of Trump's policies, such as the Tax Cuts and Jobs Act of 2017. Robert A. Altman and Phil Spencer, then the chair and vice-chair of the board, respectively, spearheaded an internal investigation into Gallagher's conduct which led to his stepping down and a intermin preside being appointed Stanley Pierre-Louis, which later became the permenate president of the ESA.

"Because AI and machine learning technology present revolutionary opportunities in both game development and game operations, we use this opportunity to call attention to industry priorities and concerns in technology policy generally and particularly, in the context of international trade and global policymaking. ESA’s comments in response to the Federal Register notice (“FRN”) focus on aspects of intellectual property, digital trade and market access that are important to the economic competitiveness of video game companies. Our submission also counsels the U.S. government to stay the course on supporting fair digital trade principles, strong intellectual property laws and an evidence-based approach to regulation to maintain the rapid pace of innovation in the AI space."

I'm seeing this pop up a lot saying the downloads were taken down due to this generic association. It's popped up for DKC on GBA, Metal Gear Solid on GBC, and Pac-Man Special Color Edition ect. Weird because other games like Sonic are supposidly removed by Sega and Mario is removed by Nintendo. Who the heck are the Entertainment Software Association? Some hacker group? Bots?
