Nintendo hired Markmonitor to issue DMCA takedown requests on their behalf. For all intents and purposes, they are "officially" Nintendo.
The reference to downloads should not be removed. This is a “non” Nintendo site after all. You don’t have to listen to that; they are not officially Nintendo.
