I kinda doubt anything will change. The emulation question has been solved for a long time. And it's rare that anyone comes after the emulators themselves, since they can be used legally with games you've ripped yourself. Besides that, many ROM sites have been up for years. Besides, PS4 emulation is only just now starting to even get anywhere. Xbox 360 emulation is currently still trying to catch up to PS3 emulation. And Xbox One, as far as I can tell, doesn't exist. Microsoft and Sony have also had plenty of chances to come after sites, but have chosen not to. Sony tried to come after emulators in 2000 and failed to win their case, even though Bleem! ended up having to close up shop.

As for the private servers thing, that question isn't resolved. An off-the-cuff and incorrect remark from the ESA doesn't make private servers suddenly illegal. There's most likely no crackdown coming, because there really isn't a need to do one.
